Unacceptable Risk

The “unacceptable risk” category encompasses AI systems that pose an immediate and unequivocal threat to individuals, warranting prohibition. This includes mechanisms designed for the cognitive manipulation of vulnerable groups or individuals, such as voice-activated toys promoting hazardous behavior in children. Additionally, it encompasses practices like social scoring, where individuals are ranked based on behavior, socioeconomic status, or personal traits, as well as real-time and remote biometric identification systems, such as facial recognition. However, exceptions exist. For instance, remote biometric identification systems may be permitted in cases of prosecuting serious crimes, subject to prior judicial authorization.

High Risk

AI systems with the potential to significantly impact security or fundamental rights fall under the “high risk” category and are further divided into two subcategories:

The first subcategory includes AI systems used in products regulated under EU product safety legislation. This encompasses a broad spectrum of products, spanning from toys and aviation technology to automobiles, medical devices, and elevators.

The second subcategory covers AI systems in eight specific areas that necessitate registration in an EU database. These areas include biometric identification, critical infrastructure management, education and vocational training, employment and labor management, access to essential private and public services, law enforcement, migration and border management, and legal assistance and law enforcement.

Limited Risk

AI applications categorized as having limited risk must adhere to minimum transparency requirements, ensuring users can make informed decisions regarding their usage. It’s crucial for users to understand when and how they interact with AI, particularly in systems generating or manipulating multimedia content like images, audio, or video (e.g., deepfake).

Low Risk

This category encompasses applications such as AI-enhanced video games or spam filters. The majority of AI systems currently deployed in the EU fall into this low-risk category.
